BY Publishing is a publishing brand operated by EYE AM STUDIOS, LLC. References to BY Publishing describe products, publications, and storefront experiences offered through EYE AM STUDIOS, LLC.

These Storefront Terms of Use govern BY Digital Store, the digital storefront operated by EYE AM STUDIOS, LLC under the BY Publishing brand.

Agreement and acceptance

By accessing BY Digital Store, creating an account, requesting access, or completing a purchase, you agree to these Terms of Use and the policies incorporated by reference, including the Privacy Policy, Refund Policy, and applicable Product License.

Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to make a purchase. By purchasing on behalf of an organization, you represent that you have authority to bind that organization to the applicable terms.

Storefront use

You may browse product information, demos, and public content for lawful evaluation.

You may not:

• bypass access controls or scrape unpublished catalog data;
• share credentials, download links, or access tokens except as permitted by license;
• attempt to access another customer's library or entitlements;
• reverse engineer, decompile, or disassemble products except where such restriction is prohibited by law;
• resell, sublicense, or redistribute products outside the applicable license;
• remove copyright, trademark, or attribution notices;
• introduce malware or interfere with storefront security;
• use automated means to extract catalog or pricing data;
• create competing derivative products beyond the scope of the applicable license;
• misrepresent your identity during purchase or support requests.

Product information and availability

Product descriptions, demos, screenshots, and pricing are provided for evaluation before purchase. EYE AM STUDIOS, LLC may correct catalog, pricing, or technical errors before fulfilling an order.

Pricing, taxes, and payment

Prices are displayed in the currency stated on the product page. Applicable taxes may be calculated and collected during checkout. Payments are processed by approved third-party payment providers, and their terms and privacy practices may also apply.

If payment has been collected for an order that cannot be fulfilled, the amount collected will be refunded. Material terms and disclosures are presented clearly before purchase, including on mobile devices.

Purchases and delivery

A purchase is complete only after payment is authorized and a corresponding entitlement or delivery record is created.

Digital products are delivered through secure download access, customer-library access, or another method stated on the product page at the time of purchase.

You are responsible for downloading, extracting, storing, and backing up purchased files in accordance with product documentation.

Customer accounts and access

You are responsible for maintaining the confidentiality of account credentials, download links, access tokens, and purchased files. You must notify support promptly if you believe access has been compromised. Access credentials and secure download links may not be shared except as expressly permitted by the applicable product license.

Refunds

Refund eligibility is governed by the Refund Policy presented before purchase. Because digital products may be accessed, downloaded, copied, or activated immediately, refund eligibility may be limited after delivery or access begins, except where required by law or where the product is materially defective or was not delivered as described.

Product licenses

Each product is licensed according to the terms presented at purchase and in the Product License. Unless expressly stated otherwise, products are licensed—not sold—and no ownership of underlying intellectual property transfers to the buyer.

Updates and version entitlements

Update entitlements, if any, are defined per product. Major-version upgrade requirements and delivery methods are described on the applicable product page and in the license terms.

Compatibility and backups

Product requirements, supported browsers, device limitations, storage behavior, and installation instructions are stated on the applicable product page or in its documentation. You are responsible for reviewing those requirements before purchase and maintaining a compatible environment.

EYE AM STUDIOS, LLC does not guarantee continued compatibility with every browser, operating system, device, extension, security setting, or third-party service. You are responsible for maintaining backup copies of local records and purchased files.

Intellectual property

The storefront, product designs, publications, software, written content, graphics, trademarks, trade dress, documentation, and related materials are owned by or licensed to EYE AM STUDIOS, LLC and are protected by applicable intellectual-property laws. No rights are granted except the limited rights expressly provided in the applicable product license.

BY Publishing, Home Property Record System™, and related product identifiers are trademarks or service marks of EYE AM STUDIOS, LLC or its affiliates.

Third-party services

The storefront may rely on third-party services for hosting, payments, email, analytics, storage, authentication, or delivery. EYE AM STUDIOS, LLC is not responsible for third-party services outside its reasonable control, although it will use commercially reasonable efforts to address storefront or delivery issues affecting completed purchases.

Professional-use disclaimer

Products are provided for informational and organizational purposes unless otherwise stated. BY Publishing products do not replace professional inspection, legal, insurance, medical, tax, engineering, or emergency advice.

Warranty disclaimer

Except as expressly stated on a product page or in a separate written agreement, products and storefront services are provided "as is" and "as available," without warranties of any kind, whether express or implied, to the fullest extent permitted by law. Non-excludable consumer rights remain unaffected where applicable.

Limitation of liability

To the fullest extent permitted by law, EYE AM STUDIOS, LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of data, lost profits, business interruption, or customer failure to maintain backups, arising out of or related to the storefront or licensed products.

To the fullest extent permitted by law, EYE AM STUDIOS, LLC's total liability for any claim relating to a specific product will not exceed the amount you paid for that product. Some jurisdictions do not allow certain limitations, so these limits may not apply to you.

Indemnification

You agree to indemnify and hold harmless EYE AM STUDIOS, LLC from claims, losses, and expenses arising from your unlawful use of the storefront or licensed products, license violations, account misuse, infringement caused by content you add, or violation of these Terms.

Order review and cancellation

EYE AM STUDIOS, LLC may reject, suspend, or cancel an order where fraud, unauthorized payment activity, pricing error, security risk, license abuse, or other material irregularity is reasonably suspected. If an order is cancelled after payment and before valid delivery, the applicable payment will be refunded.

Store and product availability

The storefront, demos, customer library, download systems, and individual products may be modified, suspended, or discontinued. Reasonable efforts will be made to preserve valid customer access or provide an alternative delivery method for completed purchases, subject to the applicable product terms and circumstances outside the company's control.

Suspension and termination

EYE AM STUDIOS, LLC may suspend or terminate storefront access, entitlements, or download access for violations of these Terms, the applicable license, fraud, or abuse.

Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Before filing suit, the parties agree to attempt good-faith informal resolution by contacting support@eyeamstudios.com.

Except for claims that may be brought in small claims court, any dispute arising out of these Terms or a completed purchase will be brought in the state or federal courts located in Hillsborough County, Florida, and each party consents to personal jurisdiction in those courts.

Changes to the Terms

EYE AM STUDIOS, LLC may update these Terms as the storefront matures. Material changes will be reflected on this page with an updated effective date and policy version.

Severability and entire agreement

If any provision is held unenforceable, the remaining provisions remain in effect. These Terms, together with the incorporated policies and applicable product license, constitute the entire agreement regarding storefront use and purchase, except for any separate written agreement expressly signed by EYE AM STUDIOS, LLC.
